Collection and storage of personal data

1) On accessing this website

On accessing the website www.cratemaker.de (and all its subpages) information is automatically sent to this website’s server via your browser (e.g. Microsoft Internet Explorer, Google Chrome, Mozilla Firefox, Opera, Apple Safari, etc.). This information is temporarily stored in a so-called log file. This applies to the following information:

  • IP address of the requesting end device (e.g. desktop PC, laptop, tablet, smartphone, etc.) on which this website is visited,

The legal basis for data processing is Art. 6(1)(1)(f) GDPR. The legitimate interest arises from the abovementioned purposes for data collection. The collected data are not used to draw conclusions about your identity.

Data processing relating to contact is carried out according to Art. 6(1)(1)(a) GDPR. The basis is your freely given consent. Another legal basis for data processing is our legitimate interest in responding to your request according to Art. 6(1)(f) GDPR.

If contact is made for the purpose of entering into a contractual relationship with us or so that we may carry out the associated pre-contractual measures, the legal basis for processing is also Art. 6(1)(b) GDPR.

The personal data collected for use of the contact form are deleted once your enquiry has been processed, provided that there are no conflicting statutory retention periods.

By email

If you send us an email, your email address (where appropriate, with the name selected by you as the sender information), the subject chosen by you and the content of your message are processed. Data processing is required in order to be able to respond to your request appropriately, to initiate the measures requested by you or to fulfil other legal obligations relating to you, which are the subject of the request. Only data that are required for the abovementioned purposes are processed.

The legal basis for data processing is our legitimate interest in responding to your request according to Art. 6(1)(f) GDPR.

If you send an email for the purpose of entering into a contractual relationship with us or so that we may carry out the associated pre-contractual measures, the legal basis for processing is also Art. 6(1)(b) GDPR.

The personal data are deleted once your request has been processed, provided that there are no conflicting statutory retention periods.

By fax or post

If you send us a letter or fax, your personal data contained therein and the communicated information are processed. Data processing is required in order to be able to respond to your request appropriately, to initiate the measures requested by you or to fulfil other legal obligations relating to you, which are the subject of the request. Only data that are required for the abovementioned purposes are processed.

The legal basis for data processing is our legitimate interest in responding to your request according to Art. 6(1)(f) GDPR.

If contact is made by post or fax for the purpose of entering into a contractual relationship with us or so that we may carry out the associated pre-contractual measures, the legal basis for processing is also Art. 6(1)(b) GDPR.

3) Contractual relationships and fulfilment of other legal claims

If you enter into a contractual relationship with us, there is a pre-contractual relationship involving obligations (contract initiation) or we have to fulfil other legal claims relating to you, then we collect the following data:

  • Salutation
  • Forename and surname
  • Address
  • Fixed line or mobile telephone number
  • Email address
  • Where appropriate, in the B2B area, the forename and surname are those of the contact people for the company.
  • Information, which is required for contract initiation, contract development or fulfilment of other legal claims relating to you.

Type and purpose of use

The abovementioned data are processed for the following purposes:

  • In order to be able to identify you as a contractual partner in the case of contract initiation or other legal claims,
  • In order to be able to comply with pre-contractual measures, the contractual relationship or other legal claims relating to you,
  • In order to correspond with you,
  • For invoicing purposes.

The legal basis for data processing is Art. 6(1)(1)(b), (c) and (f) GDPR. Data processing for the abovementioned purposes is required for appropriate implementation of the contract and/or fulfilment of other legal obligations relating to you.

The personal data are deleted following completion, provided that there are no conflicting statutory retention periods.

Transfer of data

Your personal data are only transferred to third parties if:

  • You have given your express consent according to Art. 6(1)(1)(a) GDPR,
  • The transfer is required for asserting, exercising or defending legal claims according to Art. 6(1)(1)(f) GDPR and it is not deemed that you have an exclusive, credible interest in your data not being transferred,
  • There is a legal obligation for the transfer according to Art. 6(1)(1)(c) GDPR,
  • This is legally permissible and necessary for transactions carried out under the contractual relationship with you according to Art. 6(1)(1)(b) GDPR.
  • Above and beyond this, no transfer of your personal data takes place.
Rights of the data subject

You have the following rights:

  • According to Art. 15 GDPR, you have a right to request information about whether your personal data are processed. If personal data are processed, you have a right to information about this personal data and the following information: The purposes of the processing, categories of personal data concerned, the recipients or categories of recipients to whom the personal data have been or will be disclosed, the envisaged period for which the data will be stored, the existence of the right to request from us rectification or erasure of personal data or restriction of processing, the right to lodge a complaint against this processing with a supervisory authority, the source of your data if the personal data are not collected from you, the existence of automated decision-making, including profiling and, where appropriate, meaningful information on the details;

  • According to Art. 20 GDPR, the right to receive your personal data, which you have provided to us, in a structured, commonly used and machine-readable format or to transmit those data to another controller;
  • According to Art. 7(3) GDPR, the right to withdraw the consent you have given to us at any time. The consequence of this is that we will no longer be able to carry out data processing on which this consent depends;
  • According to Art. 77 GDPR, the right to lodge a complaint with a supervisory authority. You can contact the supervisory authority for your place of residence, place of work or place of the alleged infringement.
Right of objection

If your personal data are processed based on a legitimate interest according to Art. 6(1)(1)(f) GDPR, you have the right to object to processing of your personal data according to Art. 21 GDPR on grounds relating to your particular situation or the right to object to direct marketing. Where personal data are processed for direct marketing purposes, you have a general right of objection without having to disclose your particular situation to us. Data security

This website uses the SSL protocol in conjunction with the highest levels of encryption in each case according to the level supported by your browser. This is generally 256 bit encryption. The webserver enforces your security by requesting SSL variants. Of course, the SSL certificate is regularly renewed over a specific period of time. You can tell whether a page is encrypted, because a key or a padlock symbol is displayed in the top or bottom bar in your browser. Furthermore, technical and organisation security measures have been put in place in order to protect your data against accidental or negligent manipulations, partial or complete loss, destruction or unauthorised access by third parties.
